Decision Regarding Recovery of Compensation from Former Owner of Parad Trading Center Came into Force

On April 25, 2014, the AB lawyers convinced the court of appeal to uphold the decision of the Arbitration Court of Altai Krai regarding the recovery of compensation from the former owner of the Parad Trading Center.

The case was tough from the very beginning. Two hearings of the case were held in the Seventh Arbitration Court of Appeal. During the first hearing, the defendants applied for the temporary stay of proceedings and a forensic construction and technical expert examination.

We managed to withdraw the defendant’s arguments regarding the first application, which was turned down. 

To consider the second application, the court needed more time and postponed the hearing. Our experts undertook a considerable amount of work to justify the necessity to turn down the application. Each defendant’s argument was carefully examined and rebuttal arguments prepared. A law enforcement practice of the Seventh Arbitration Court of Appeal applied in a similar case was thoroughly studied.

As a result, an 11-page objection to the defendant’s 3-page application was prepared and sent to court.

Having considered the arguments, the three judges concurred with us and turned down the examination application.

 

The first instance court decision was also upheld.
