As a reminder, a conflict occurred involving the Izumrudnyi Recreation Park earlier this spring, when the Administration of Oktyabrsky District did not recommend the residents to visit the park, and the Regional Administration declared the land lease contract with ООО Oktyabrsky Recreation and Culture Park (aka Izumrudnyi Park) avoided.
Within several weeks, the Administration of Oktyabrsky District of Barnaul handed down 10 decisions incurring the park’s administrative liability.
The representatives of the Izumrudnyi Park believe that imposing administrative liability on them was required to justify the Regional Administration’s claims regarding the termination of the lease contract with the ООО Oktyabrsky Recreation and Culture Park that had been reviewed by the Arbitration Court of Altai Krai earlier this summer.
Our firm represented the Park in all the abovementioned cases.
In August, we managed to assert the park’s lease contract in the first instance court, which ruled to reject the avoidance claim.
In late August and early September, the Oktyabrsky District Court of Barnaul rescinded the resolutions penalizing the OOO Oktyabrsky Recreation and Culture Park for violation of the Barnaul Municipal Improvement Rules.

“We have consulted the administrative cases against ООО Oktyabrsky Recreation and Culture Park and found out violations of the procedure for administrative prosecution of the company. For the time being, we managed to have rescinded seven resolutions out of 10 made by the Administration Committee about the company. The general concern we have is whether the actions of the Oktyabrsky District Administration can be justified. No decision regarding the rest of the resolutions has yet been made by the court.”
The park has never been held responsible for violation of municipal improvement rules, which makes the increased attention of the media and state bodies to the park peculiar.
